Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. The Terms and Conditions set out below apply to all participants submitting entries for the “Cadbury cash in on your cravings“ Promotion. The campaign has been approved by the Lotteries Board of Zambia.

 

  • The Competition is open to permanent residents and citizens of Zambia over the age of 18 (eighteen) years in possession of a valid Zambia Identity Document except for any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their agencies, advisers, dealers, suppliers, its affiliates and/or associated companies (“Disqualified Persons”).

 

  • The Competition is only valid within Zambia. Participants must be within Zambia at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a finalist, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.

 

 

  • By entering the Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.

 

                                    PROMOTION PERIOD

 

  • The Competition commences on 1 August 2020 and ends on 30 September 2020 both days inclusive. No entries received after midnight on the 30 September 2020 will be accepted.
  • The duration of the promotion may be extended or curtailed at the discretion of the promoter.
  • Promotion is valid while stocks last. The qualifying products are subject to stock availability at the time of purchase and vary by store.

 

                                     PRIZES

 

  • There are a total of 2062 prize items to the total value is 250 000 KW to be won. The prize items (“Prizes”) are:
    • 36 x KW 3000 cash (Total KW 108 000) (weekly prizes)
    • 4 x TVs (weekly prize)
    • 12x Bar fridges (weekly prize)
    • 9 x solar panels (weekly prize)
    • 2000 x KW 10 airtime (Total KW 20 000) (weekly prize)
    • 1 X KW 25 000 Grand cash prize (Total KW 25 000) (Grand prize)

 

  • Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated at the Promoters’ discretion to another winner.

 

  • All Prize finalists will be required to provide their original till slip for their purchase, dated and timed before their entry date and time, as proof of purchase for the qualifying products upon receiving a phone call to announce that they are a finalist. Should the finalist not be able to provide a scan or photograph of the original slip to the Promoter on request, they will be disqualified. The slip is not to be written on or tampered with in anyway.

 

  • All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.

 

                                      HOW DO I ENTER?

 
To stand a chance of winning one of the Prizes, participants must;

  • Purchase any 1 of below-participating products from Participating Stores. Participating SKU’s can be found in clause 21.
  • SMS the last 4 digits the barcode of participating product to 076 311 2426. Standard network rates apply. Free minutes do not apply. Consumers are requested to keep their participating till slip and take a photo or scan the till slip for safekeeping should they be required to present it
  • Consumers are able to enter multiple times and all competition entrants will be considered for the grand prize draw irrespective if they have won a weekly prize or not.
  • The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider.
  • Participants may enter the promotional competition multiple times over the promotional period, provided that participants purchase the Participating Products each time and complete the steps outlined in rule 6. Participants are only eligible for 1 (one) weekly Prize Item under this Promotional Competition, subject to the following conditions:

No computer-based entries will be accepted for the SMS promotion

  • Entries which are unclear, illegible or contain errors or from Disqualified Persons will be declared
  • The Prizes are neither transferable nor redeemable for cash and the Promoters are not liable for any defect in the Prizes. The Promoters reserve the right to substitute Prizes with any other prize of comparable commercial value.

 

                              AWARDING OF PRIZES

 

  • The Promoters will conduct a weekly and grand prize random draw for the weekly prizes and the grand prize from all the entries received to determine possible winners. The grand prize draw will take place no later than the 2nd of October 2020. In order for the particular entry to be confirmed as valid, Promoters will call the possible winners and conduct a Promotional Competition verification process. This process includes;
  • Contacting the finalist and all finalists will be required to submit a finalist form as well as proof of purchase in the form of an original till slip that can’t be tampered with in any way or illegible.
  • The finalist will have 24 hours to submit the documents via email or WhatsApp to the promoter.
  • If the documents are not submitted the finalist will be disqualified and the prize will revert back to the promoter.
  • All weekly prizes and Grand Prize finalists will first be notified via telephone. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts) then such finalist will forfeit their prize and another finalist will be randomly selected and the same process as described herein will be followed
  • The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
  • The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion as determined by Promoter in its sole discretion.
  • The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
  • The Promoters may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
  • Any dispute with number ownership (such as more than one individual claiming to be the owner of the same mobile/ contact number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.
  • All Cash prize finalists will be contacted within 48 hours of being drawn.
  • If the Promoter is unable to reach any person or complete the verification process after drawing a possible winner’s entry for whatsoever reason, such person will be disqualified, and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.

 

                               CASH PRIZES

 
The Cash Prizes will be delivered via Western Union. A reference number will be sent to the winner and they will need to use this reference number and provide a copy of their ID in order to claim their cash prize at a Western Union location. If a Cash Prize winner is unable to redeem the Cash Prize for any reason, the Cash Prize will be forfeited, and the Promoter will move on to the next finalist.

 

                               AIRTIME PRIZES

 

  • Participants will be notified via SMS if they are a winner of an Airtime Prize. Airtime Prizes will only be loaded onto the prepaid account holders.
  • In most circumstances the Airtime Prizes will load instantly, but in the case of unavoidable network delivery delays it may take up to 5 (five) business days for the Airtime Prize to reflect.

 

                              TERMS OF DELIVERY OF PHYSICAL PRIZES:

 
Physical prizes will be delivered to the store where products were purchased (within major cities)

within 6 – 8 weeks from receiving all the requested documentation. Deliveries will only be made to the store where products were purchased (no postal addresses) where someone is able to sign for the prize on weekdays during working hours. The prize will be handed over in the presence of the store manager and a representative from L&A. In the case that a winner can’t collect from the store, delivery to the winner home address or nearest landmark will be arranged but this will only be considered in extreme circumstances (elderly, disability, sickness, etc.). A winner is able to arrange that someone collects the prize from the store on their behalf if they are unable to collect themselves and must provide documentation of the person who will be collecting on their behalf. Deliveries to high theft risk / special delivery areas will require an alternative address within a major city/town or the winner will be able to collect the prize from the nearest store. Any risks in relation to the prizes will pass to the winner once delivered regardless of who has signed for the parcel at the specified address.

The promoter is not responsible for any undelivered prizes due to any incorrect details being provided by the winner with regards to their preferred delivery address or being unavailable to sign for their prize. The promoter will not be responsible for any lost, stolen, or damaged prizes once the prize has been signed for. The courier may allow someone other than the consignee present at the delivery address to sign for the prize delivery if the consignee is unavailable or unreachable – it is, therefore, the winner’s responsibility to ensure they provide a safe low-risk address/destination for delivery.

Winners may be required to sign Indemnities and/or Consent Forms when accepting their prize.

The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.

                               INDEMNITY

 

  • To the extent permitted by the Consumer Protection Act and any other applicable law:
  • The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Promotion.
  • The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
  • The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age, place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omission may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  • Neither Promoter nor its agents or distributors will have any liability in relation to this Promotion.
  • By participating in this Promotion, participants agree to allow Marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to Opt Out with every SMS received, with the exception of the first SMS.
  • The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.

 

                               CONFIDENTIALITY

 

  • Participants of this promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
  • By entering this Promotion, participants authorize the Promoter to collect, store, and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
  • By entering this Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline to participate in any promotional activity or to object to these images being used by written notification to the Promoter at Mondelez South Africa (Pty) limited, 6 Woodmead Estate, Woodmead, Sandton 2191 Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.

 

                                  GENERAL

 

  • The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonable deems necessary.
  • The onus rests on the participants to check the website for updates to the Terms and Conditions.
  • No liability shall lie on the Promoter in favour of any participant, winner(s), and/or a third party arising from such cancellation, suspension, or termination. Therefore, the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.
  • The Promoters decision is final, and no correspondence will be entered into. This Promotion is in no way sponsored, endorsed or administered by or associated with Facebook.
  • In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:
  • It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
  • It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
  • This Promotion is not applicable in conjunction with any other offers/ promotions offered by the Promoter.
  • In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize winners to complete and submit an information disclosure agreement and indemnification, as well as supply a copy of their valid ID within 24 hours of being confirmed a winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoter.
  • Entries that are unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or from Disqualified Persons will be declared invalid.
  • Each Participant acknowledges and accepts that its personal information and details shall be shared with Mondelez South Africa Proprietary Limited and/or its agents and/or its contractors to the extent necessary and for purposes of this Competition.
  • Prize images on the Point of Sale promotional material are used to represent the prizes for illustration purposes only, and might differ from the actual prizes awarded.
  • All Personal Information of Participants shall be handled in accordance with all the relevant consumer protection laws and legislation and data protection laws and legislation of Zambia.
  • By entering the Competition, the Participants agree that Mondelez and its affiliates (including the Promoter, agencies, subsidiaries, packaging, distribution, and joint ventures) may contact the Participants via SMS, email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Promoter for such purpose.
  • Should any dispute arise in relation to the interpretation of these competition rules, the Promoters’ decision shall be final and no correspondence shall be entered into.
