Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. The Terms and Conditions set out below apply to all participants submitting entries for the Shoprite Cross Category Promotion.
1. The Competition is open to permanent residents and citizens of Zambia over the age of 18 (eighteen) years in possession of a valid Zambia Identity Document except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their agencies, advisers, dealers, suppliers, its affiliates and/or associated companies (“Disqualified Persons”).

2. The Competition is only valid within Zambia. Participants must be within Zambia at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a finalist, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.

3. By entering the Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.

4. PROMOTION PERIOD

4.1 The Competition commences on 8 November 2019 and ends on 3 January 2020 both days inclusive. No entries received after midnight on the 31 December 2019 will be accepted.

4.2 The duration of the promotion may be extended or curtailed at the discretion of the promoter.

4.3 Promotion is valid while stocks last. The qualifying products are subject to stock availability at the time of purchase and vary by store.

5. PRIZES

5.1 There is a total of 11 prizes items to be won. Total value is KW 235,000. The prize items (“Prizes”) are: 5.1.1 10 x KW5000 cash vouchers 5.1.2 1 x Trip for 4 to Mauritius
5.2 Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated at the Promoters’ discretion to another winner.

5.3 All Prize finalists will be required to provide their original till slip for their purchase, dated and timed before their entry date and time, as proof of purchase for the qualifying products upon receiving a phone call to announce that they are a finalist. Should the finalist not be able to provide a scan or photograph of the original slip to the Promoter on request, they will be disqualified. The slip is not to be written on or tampered with in anyway.

5.4 All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.

6. HOW DO I ENTER?

6.1 To stand a chance of winning one of the Prizes, participants must; Purchase any 1 of below bundles from Participating Shoprite Stores which includes 2 x Stimrol product. Participating SKU’s can be found in clause 23.

6.2 SMS the till slip number to +260763112426. Standard network rates apply. Free minutes do not apply. Consumers are requested to keep their tillslip

6.3 Consumers are able to enter multiple times and all competition entrants will be considered for the grand prize draw irrespective if they have won a cash prize or not.

6.4 The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider.

7. Participants may enter the promotional competition multiple times over the promotional period, provided that participants purchase the Participating Products each time and complete the steps outlined in rule 6. Participants are only eligible for 1 (one) Cash Prize Item under this Promotional Competition, subject to the following conditions:

7.1 No computer-based entries will be accepted for the SMS promotion
8. Entries which are unclear, illegible or contain errors or from Disqualified Persons will be declared invalid.

9. The Prizes are neither transferable nor redeemable for cash and the Promoters are not liable for any defect in the Prizes. The Promoters reserve the right to substitute Prizes with any other prize of comparable commercial value.

10. AWARDING OF PRIZES

10.1 The Promoters will conduct a weekly and grand prize random draw for the cash and trip prizes from all the entries received to determine possible winners. The grand prize draw will take place no later than the 5th of January2019. In order for the particular entry to be confirmed as valid, Promoters will call the possible winners and conduct a Promotional Competition verification process. This process includes;

10.1.1 Contacting the finalist and all finalists will be required to submit a finalist form as well as proof of purchase in the form of a original till slip that can’t be tampered with in anyway or illegible.

10.1.2 The finalist will have 24 hours to submit the documents via email or WhatsApp to the promoter.

10.1.3 If the documents are not submitted the finalist will be disqualified and the prize will revert back to the promoter.

10.2 All cash prize and Main Prize finalists will first be notified via telephone. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts) then such finalist will forfeit their prize and another finalist will be randomly selected and the same process as described herein will be followed

10.3 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.

10.4 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.

10.5 The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.

10.6 The Promoters may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.

10.7 Any dispute with number ownership (such as more than one individual claiming to be the owner of the same mobile/ contact number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.

10.8 All Cash prize finalists will be contacted within 48 hours of being drawn.

10.9 If the Promoter is unable to reach any person or complete the verification process after drawing a possible winner’s entry for whatsoever reason, such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.

11. TRIP PRIZE

11.1 The Trip Prize Winner and their Travel Partner must be available to travel together to the between 1 January – August 2020 (“Travel Dates”). Should the Winner be unavailable to take up the Trip Prize on the Travel Dates, provided and determined by Promoters, the Winner and their Travel Partner will be deemed to have forfeited the Trip Prize. In such event the Trip Prize will revert back to the Promoter.

11.2 Should the Winner of a Trip Prize wish to make any changes in any way whatsoever to the Trip Prize, other than what will be arranged by the Promoter, including Travel Dates and the number of Travel Partners, such costs, charges, expenses or any such adaptions or variations to the Trip prize, will be on the Winners own account.

11.3 Participants stand a chance of winning 1 (one) Trip Prize, for the Winner and 3 x Travel Partners, to any Mauritius.

11.4 The Promoter will conduct a random, audited, at the end of the promotion, from all the Entries received for the Duration.

11.5 The Promoter will call the possible Winner and conduct a Competition verification process (“Verification Process”).

11.5.1 The Verification Process will consist of the following:

11.5.2 contacting the possible Winner and confirming the Winner and their Travel Partner hold a valid Zambian Identity document AND valid Passports ; and

11.5.3 the Winner will be required to fill in a Winner form and indemnity, which needs to be returned to the Promoter within 24 (twenty-four) hours.

12. TRAVELLING ABROAD:

12.1 In order to travel abroad, possible Winners may be required to submit copies of their and their Travel Partner valid passports (collectively “the Travelers”), after being declared a winner and after successfully completing the Verification Process in terms of Rule 11.5 above. Should any Traveller and/or their Travel Partner not be in possession of a valid passport, possible Winner and their Travel Partner will be deemed to have forfeited their Trip Prize.

12.2 The possible Winner and their Travel Partners’ passport must be valid for at least 6 (six) months from the stipulated date of return from the Trip Prize destination, and must have 2 (two) blank/unstamped pages in the passport.

12.3 Where the destination country requires that a visitor to be in possession of a valid visa, the Travelers must be eligible for a visa to the Trip Prize and are required to disclose upfront any possible reason for Embassy rejection. For the avoidance of doubt, should a possible Winner and/or any of their Travel Partner be refused a visa to travel to their destination of choice, such possible Winner and their Travel Partner will be deemed to have forfeited that chosen Trip Prize and a new winner will be declared.

12.4 Clear passport copies must be emailed to the Promoter, to an e-mail address only provided by the Promoter, reflecting the photograph, name, passport number, date of issue and expiry date of the travellers. Blurred or obscured copies will result in disqualification.

12.5 Travelers must also comply with any other travel requirements for entry into a destination country, including any inoculations at the Promoter’s expense, failing which the possible Winner and/or Travel Partner will be deemed to have forfeited their Trip Prize

12.6 Participants, whose Entries have been drawn and have been confirmed as valid after the Verification Process, will be notified telephonically within 24 (twenty-four) hours from receipt of valid documentation set out in Rules 11.5.1 above and after being declared a Winner. The validity of such documentation is at the Promoter’s discretion.

12.7 The Winner and their Travel Partner will be required to sign the Promoter’s indemnity forms. Should the Winner and/or Travel Partner refuse or fail to do so for any reason whatsoever, the Winner will be deemed to have forfeited the Trip Prize. In such event the Trip Prize will revert back to the Promoter.

12.8 Travel, hotel reservations and events/excursions are subject to availability and may not be available on certain dates. Travel Dates may be varied and any or all amendments to Travel Dates will be at the promoter’s discretion.

12.9 The Trip Prize includes travel costs to and from the chosen destination, including flight costs where applicable, hotel or bed and breakfast accommodation, hotel or bed and breakfast meals offered, and selected excursions, as determined by the Promoter.

12.10 No correspondence will be entered into as to the promoter’s choice of airline, ticket class, hotel or bed and breakfast accommodation, all of which inclining the length of stay is at the promoter’s discretion.

12.11 The Promoter will not be responsible for any other expenses, which the Winner and their Travel Partners may incur as a result of their acceptance and/or use of the Trip Prize whether foreseen or not.

12.12 Ancillary costs, including but not limited to, additional transport, additional meals outside of those paid by the Promoter, personal and incidental expenses, government taxes, management fees or other fees applicable are not the responsibility of the Promoter.

12.13 The Promoter will cover the Winner and Travel Partners’ basic travel insurance, the level of cover will be determined at the Promoter’s sole discretion. In the event that the Winner and/or Travel Partner wish to increase the level of insurance cover, this increase in cover will be at the Winner and/or Travel Partners’ sole cost and expense.

12.14 The Promoter shall not be responsible for any changes, substitution, withdrawal, cancellation or postponement of any part of the itinerary beyond its reasonable control. The Promoter is not obliged to award any other prizes in lieu if any such event or aspect of the trip is cancelled, postponed, substituted, withdrawn, changed or unavailable.

12.15 The Prize Winners and their Travel Partners are obliged to behave responsibly at all times and comply with the Competition rules and all reasonable requests of the Promoter and its agents. In the event that the prize Winner and/or Travel Partner acts in any manner that brings Mondelez, the Promoter, its affiliates and/or associated companies’ name into disrepute at any time (including but not limited to display or publicize any political slogans, child pornography, or use homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt Brand sponsorship or anything else deemed to be ambush marketing, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights), the Promoter or its agent shall, at its sole discretion and without any form of compensation to the Winner and their Travel Partners, and without limitation to any other claim the Promoter may have under law; arrange for the Winner and their Travel Partner’s’ return to the Provinces of Residence in Zambia.

12.16 If the Promoter is unable to reach any Trip Prize Winner after 3 (three) day from the date of being declared a Winner, or if a Trip Prize Winner fails the Verification process after their Entry is drawn for whatsoever reason, such person will be disqualified and a draw for a replacement Entry and Winner will take place.

12.17 All the Competition Prizes are neither transferable nor redeemable for cash and the Promoter is not liable for any defect in the Trip Prize. The Promoter reserve the right to substitute Trip Prize with any other prize of comparable commercial value.

13. INDEMNITY

13.1 To the extent permitted by the Consumer Protection Act and any other applicable law:

13.1.1 The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.

13.1.2 The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

13.1.3 The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age, place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omission may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13.1.4 The Promoter reserves the right to request the Participant to present the wrappers with the unique codes in the instance where there is a dispute related to entries and rewards. Should the wrappers not be presented, the Participant may be found to not be the rightful purchaser of the unique code in question and the entry or reward may be disqualified.

13.1.5 Neither Promoter nor its agents or distributors will have any liability in relation to this Promotion.

13.1.6 By participating in this Promotion, participants agree to allow Marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to Opt Out with every SMS received, with the exception of the first SMS.

13.1.7 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.

14. CONFIDENTIALITY

14.1 Participants of this promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.

14.2 By entering this Promotion, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.

14.3 By entering this Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at Mondelez South Africa (Pty) limited, 6 Woodmead Estate, Woodmead, Sandton 2191 Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.

15. GENERAL

15.1 The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonable deems necessary.

15.2 The onus rests on the participants to check the website for updates to the Terms and Conditions.

15.3 No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.

15.4 The Promoters decision is final, and no correspondence will be entered into. This Promotion is in no way sponsored, endorsed or administered by or associated with Facebook.

15.5 In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:

15.5.1 It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;

15.5.2 It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

15.6 This Promotion is not applicable in conjunction with any other offers/ promotions offered by the Promoter.

15.7 In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize winners to complete and submit an information disclosure agreement and indemnification, as well as supply a copy of their valid ID within 24 hours of being confirmed a winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoter.

15.8 Entries that are unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or from Disqualified Persons will be declared invalid.

16. Each Participant acknowledges and accepts that its personal information and details shall be shared with Mondelez South Africa (PTY) Limited and/or its agents and/or its contractors to the extent necessary and for purposes of this Competition.

17. Prize images on the Point of Sale promotional material are used to represent the prizes for illustration purposes only, and might differ from the actual prizes awarded.

18. All Personal Information of Participants shall be handled in accordance with all the relevant consumer protection laws and legislation and data protection laws and legislation of Zambia.

19. By entering the Competition, the Participants agree that Mondelez and its affiliates (including the Promoter, agencies, subsidiaries, packaging, distribution and joint ventures) may contact the Participants via SMS, email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Promoter for such purpose.

20. Should any dispute arise in relation to the interpretation of these competition rules, the Promoters’ decision shall be final and no correspondence shall be entered into.
